Why do I need a Will?
At SBC Legal Services, we understand the value of securing your family’s future. An estate plan and a properly drafted Will can ensure that your loved ones receive the benefits of your estate the way you intend after your death. As an estate planning attorney, we will see to it that any Will we draft complies with all applicable laws and is properly validated. If a Will is contested and the court finds it was not properly validated, the estate may be divided according to the laws of North Carolina and not based on the intent of the requestor.
In the absence of a Will, when a person dies, the laws of North Carolina will govern through “intestate succession”. The division of assets will depend on whether the deceased has a spouse, children, or living parents. This can lead to confusion and disputes amongst the surviving family members as to how those assets should be divided. This can be prevented with a properly validated Will.
Our estate planning attorney understands how to structure a Will to minimize the tax implications that the estate and its beneficiaries may face when a loved one dies. Our attorney can assist you in determining whether a simple Will is sufficient for the division of your assets or whether another mechanism such as a Trust is needed.
